SWEEPSTAKES: The Apex Bus “Apex Reward Program Grand Opening” (the “Sweepstakes”) starts February 04, 2008 at 12:00 a.m. ET and ends February 29, 2007 at 11:59 p.m. ET (the "Sweepstakes Period").

ELIGIBILITY: To be eligible to enter, you must be registered on www.ApexBus.com  (the “Web Site”) and have a complete name, email address and phone number  on file with Sponsor to enable us to contact you by email or phone number in the event your entry is selected in the Sweepstakes.  Potential winners may be required to provide proof of legal photo I.D. by Sponsor to determine eligibility and as a condition of prize award.

PRIZE: One (1) Grand Prize will be awarded consisting of one (1) iPod Touch(16GB).  Estimated retail value is $399.  

Three(3) Second Prizes will be awarded consisting one (1) iPod Nano(8GB). Estimated retail value is $199.

Ten(10) Third Prizes will be awarded consisting one (1) free round trip ticket sold on ApexBus.com

GENERAL: Sweepstakes is subject to the laws of the United States only.  Except as determined by Sponsor in its sole discretion, no substitution of prize is offered, no transfer of prize to a third party is permitted, and non-cash prizes may not be redeemed for cash value.  Any difference between stated approximate value of prize and actual value of prize will not be awarded. Grand Prize winner will be solely responsible for all applicable federal, state and local taxes on prize.  Any portion of a prize not accepted by winner will be forfeited.

DRAWING: Potential Prize winners will be selected  based on the amount of ApexPoints earned during Sweepstakes Period. All customers who have earned during the period will be ranked by ApexPoints on March 1^st, 2008.

CONDUCT:  By entering this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the judges that shall be final and binding in all respects.  These Official Rules are accessible from the Web Site throughout the Sweepstakes Period.  Failure to comply with these Official Rules may result in disqualification.  Sponsor reserves the right at its sole discretion to disqualify any individual suspected of tampering with the entry process or the operation of the Sweepstakes or the Web Site; or to be acting in any manner deemed by Sponsor to be in violation of the Official Rules; or to be acting in any manner deemed by Sponsor to be unsportsmanlike or disruptive, or with intent to annoy, abuse, threaten or harass any other person.  CAUTION: ANY ATTEMPT BY A USER OR ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND COSTS (INCLUDING WITHOUT LIMIATION, ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

LIMITATIONS OF LIABILITY: Sponsor assumes no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty, failed, garbled or jumbled electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Sweepstakes; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of the operation of the Sweepstakes; (d) inaccessibility or unavailability of the Internet or the Web Site or any combination thereof, or; (e) any injury or damage to participant’s or to any other person's computer which may be related to or resulting from any attempt to participate in the Sweepstakes or download any materials in the Sweepstakes.  If, for any reason, the Sweepstakes is not capable of running as planned for reasons which may include without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes in whole or in part.

WINNER NOTIFICATION: Potential Grand Prize winner will be notified by email and phone on file with Sponsor.  Any failed winner notification will result in prize forfeiture and an alternate winner may be selected at Sponsor’s discretion. All prizes can only be picked up at 13 Allen Street, New York, NY 10002 (212-343-3280) between 03/01/2008-03/31/2008 by Potential Grand Prize winner with Photo I.D..  Any prize not claimed within the time frame will be forfeited.
